1. Introduction
Welcome to Fund My Case ("we", "our", "us"), India's dedicated litigation finance company. By accessing www.fundmycase.in or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.
2. Nature of Services
Fund My Case finances legal cases on a non-recourse basis - meaning repayment is contingent solely on a successful outcome. If your case is unsuccessful, you owe us nothing. The specific terms of each financing arrangement are governed by a separate Service Agreement executed between the parties.
3. Eligibility
Our services are available to:
- Individuals aged 18 years and above with a lawful and legitimate legal claim
- Registered businesses, SMEs, and corporates with valid commercial claims
- NRIs with domestic or cross-border legal claims in India
- Societies, trusts, and institutions pursuing legitimate legal recovery
We reserve the right to decline financing for any case at our sole discretion.
4. No Legal Advice
Information on this website is for general informational purposes only and does not constitute legal advice. Fund My Case is not your legal counsel by virtue of your use of this platform. Please consult a qualified legal professional for advice specific to your matter.
5. Confidentiality
All case-related information shared with us is treated as strictly confidential. A formal Non-Disclosure Agreement (NDA) is executed before any case documents or sensitive materials are reviewed.
6. Onboarding and Service Agreement
Formal engagement begins upon execution of a Service Agreement and payment of the applicable onboarding fee. The Service Agreement sets out the financing terms, success fee structure, use of funds, repayment conditions, and all other material terms of the arrangement.
7. Success Fee
Upon successful recovery, Fund My Case is entitled to a success fee as specified in the applicable Service Agreement. The success fee is calculated as a percentage of the recovered amount or a fixed multiple of the financed amount, agreed in writing at the time of onboarding.
8. No Control Over Legal Strategy
Fund My Case does not direct, control, or interfere with your legal strategy, choice of advocate, or conduct of proceedings. All legal decisions remain entirely with you and your legal counsel.
9. Intellectual Property
All content on www.fundmycase.in - including text, design, logos, graphics, and brand elements - is the intellectual property of Fund My Case. Reproduction or use of any content without prior written permission is strictly prohibited.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Fund My Case shall not be liable for any indirect, incidental, or consequential damages arising from use of this platform or reliance on any information provided herein.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, India.
12. Amendments
We reserve the right to update these Terms at any time. Material changes will be communicated via a notice on our website. Continued use of the platform constitutes acceptance of the revised terms.
