Funding is non-recourse: if the claim fails, you owe nothing under the funding agreement and the loss falls on the funder. Before anyone can take that risk, the claim has to be examined properly, and that examination is real work, done by people, whatever the answer turns out to be.

The fee pays for that work: reading the papers, testing the merits and the limitation position, checking whether the other side can actually pay, and mapping the enforcement route. It is charged whether the outcome is a yes or a no, because the work is the same either way. It is not a charge for saying yes.
